These Terms and Conditions (“Terms”) govern your access to and use of the website located at heatpumpwise.co.uk, operated by Bunjee Platforms Ltd (trading as Heat Pump Wise). Please read them carefully before using this website. By accessing this website or submitting an enquiry, you agree to be bound by these Terms.

1. Definitions and Interpretation

1.1

In these Terms, the following definitions apply:

  • “Company”, “we”, “us”, or “our” means Bunjee Platforms Ltd (Company No. 14213818), a company registered in England and Wales, trading as Heat Pump Wise, with its registered office at Flat 1, 275 New North Road, London, N1 7AA, United Kingdom;
  • “Website” means heatpumpwise.co.uk and all pages, subdomains, and content published thereunder;
  • “User”, “you”, or “your” means any person accessing the Website or submitting an enquiry through it;
  • “Distribution Partners” means third-party quote distribution organisations, aggregators, and specialist matching services that receive enquiry data from the Company and route it to Installers;
  • “Installers” means third-party heat pump installation businesses introduced to Users through the Company's service or through a Distribution Partner's network;
  • “Enquiry” means the personal and property data submitted by a User via the Company's online quote request form.
1.2

References to clauses refer to the clauses of these Terms. Headings are inserted for convenience only and shall not affect the interpretation of these Terms.

2. Agreement to Terms

2.1

By accessing the Website or submitting an Enquiry, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must cease using the Website immediately.

2.2

We reserve the right to amend these Terms at any time at our sole discretion. The date of the most recent revision is displayed at the top of this page. Continued use of the Website following the publication of any amendment constitutes your acceptance of the revised Terms.

2.3

You must be aged 18 or over and resident in the United Kingdom to submit an Enquiry through this Website.

3. Nature of Service

3.1

Heat Pump Wise operates as a commercial quote facilitation and data routing service. The Company collects heat pump and heating upgrade requirements from Users via its online quote request form and routes those Enquiries to Distribution Partners and Installers who may be able to fulfil the User's requirements. The Company does not itself supply, install, commission, maintain, repair, or guarantee any heat pump, boiler, cylinder, radiator, or any other heating product or service, and the Company does not administer, award, or guarantee any government grant.

3.2

By submitting an Enquiry, you consent to your contact details and property information being shared with Distribution Partners and Installers, who may subsequently contact you by telephone or email with quotations and information relevant to your stated requirements. 4. Introduction Only — Exclusion of Liability for Third-Party Services

4.1

The Company acts strictly and exclusively as a data routing and introduction service. The Company is not a party to any contract, service agreement, installation agreement, or arrangement of any kind entered into between a User and any Installer or Distribution Partner. The Company accepts no liability whatsoever — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — for any property damage, structural damage, personal injury, financial loss, sub-standard workmanship, delay, non-performance, or dispute of any nature arising from any product, service, or conduct of any Installer or Distribution Partner introduced through this Website.

4.2

Any contract for the supply and/or installation of a heat pump or related heating services is formed solely and directly between the User and the relevant Installer. The Company is not a contracting party to, a guarantor of, or in any way responsible for the performance of obligations arising under, any such agreement.

4.3

The Company gives no representation or warranty, express or implied, as to:

  • the quality, safety, suitability, or fitness for purpose of any heat pump, heating product, or installation carried out by any Installer;
  • whether any User will qualify for, or receive, any government grant (including the Boiler Upgrade Scheme), the amount of any such grant, or the time taken to process it;
  • the accuracy, completeness, or competitiveness of any quotation, estimate, or recommendation provided by any Installer or Distribution Partner;
  • whether any Installer holds, has maintained, or is in good standing with any accreditation, certification, or regulatory approval they represent themselves as holding (including but not limited to MCS, TrustMark, or any equivalent scheme);
  • the financial standing, conduct, reliability, or performance of any Installer or Distribution Partner; or
  • the number of contacts a User will receive or the availability of Installers in any particular area.
4.4

Any dispute, claim, complaint, or legal proceeding arising from or in connection with an installation, a quotation, or any other interaction between a User and an Installer or Distribution Partner must be directed exclusively to the relevant Installer or Distribution Partner. The Company will not act as a mediator, arbitrator, or adjudicator in any such dispute and is under no obligation to intervene.

4.5

The User agrees to indemnify and hold harmless the Company, its directors, officers, employees, and agents from and against all claims, demands, proceedings, losses, damages, liabilities, and costs (including legal costs on a full indemnity basis) arising from or in connection with the User's interaction with, or the products or services provided by, any Installer or Distribution Partner introduced through the Company's platform.

5. Commercial Relationships and Referral Fees

5.1

Heat Pump Wise is a commercial quote facilitation business. The Company receives a referral fee or commission from its Distribution Partners upon successful routing and acceptance of a User's Enquiry. This fee is paid by the Distribution Partner; the User is not charged for submitting an Enquiry.

5.2

The existence of this commercial arrangement means that the Company does not claim to be impartial or to act in a purely advisory capacity. The routing of Enquiries to Distribution Partners is based on partner geographic coverage, enquiry acceptance criteria, and availability at the time of submission. The Company does not guarantee that a User will be connected with every available Installer in their area, nor that any quotation received represents the lowest available market price.

5.3

Users are strongly encouraged to obtain multiple independent quotations and to conduct their own due diligence — including verification of any Installer's accreditations, insurance, and references — before entering into any contract for installation works.

6. Acceptable Use of This Website

6.1

The User agrees to use this Website only for lawful purposes and in accordance with these Terms. By submitting an Enquiry, the User warrants that all information provided is accurate, complete, and truthful and that they are the lawful occupier or owner of the property in respect of which the Enquiry is submitted, or that they have the authority of such person to make the Enquiry.

6.2

The User must not:

  • submit false, fictitious, fraudulent, or materially misleading information via any form on this Website, including the use of a false name, non-existent postcode or address, fabricated telephone number, or an email address not owned or controlled by the User;
  • submit Enquiries on behalf of a third party without that party's prior knowledge and explicit consent;
  • use this Website in any manner that infringes any applicable local, national, or international law or regulation, including consumer protection legislation and data protection law;
  • attempt to gain unauthorised access to any part of the Website, or to any server, database, or system connected to the Website;
  • introduce, upload, or transmit to the Website any virus, trojan horse, worm, logic bomb, ransomware, spyware, or other malicious or technologically harmful code;
  • use any automated means — including bots, crawlers, scrapers, spiders, or data-harvesting tools — to access, copy, index, or reproduce any content from this Website without the Company's prior written consent; or
  • deploy automated form-fillers, bot traffic, synthetic browser sessions, or any non-human mechanism to submit Enquiries through this Website or to interact with any endpoint operated by the Company.
6.3

The Company reserves the right to suspend or permanently block access to the Website for any User it reasonably believes to be in breach of clause 6.2, without prior notice.

7. Indemnity

7.1

The Company's enquiry routing infrastructure incurs direct and measurable commercial costs in respect of every Enquiry routed through its platform. The User acknowledges and accepts that:

  • the submission of fraudulent, fictitious, or materially inaccurate Enquiry data causes direct financial harm to the Company, including wasted routing expenditure, partner enquiry rejection fees, and associated operational costs;
  • the deployment of bots, automated scripts, or any non-human mechanism to interact with the Company's form endpoints or infrastructure constitutes a deliberate and injurious attack on the Company's commercial operations; and
  • the Company reserves the right to seek full recovery of all direct and consequential losses arising from fraudulent, automated, or abusive traffic, including without limitation distribution costs, partner rejection charges, platform remediation expenditure, and reasonable legal costs.
7.2

The User agrees to fully indemnify and keep indemnified the Company, its directors, officers, employees, and agents from and against all losses, claims, proceedings, demands, damages, liabilities, and costs (including legal costs on a full indemnity basis) arising from or in connection with:

  • the User's submission of false, inaccurate, fictitious, or fraudulent information through the Company's platform;
  • the User's deployment or use of bots, automated form-fillers, scrapers, or any non-human mechanism against the Company's platform or endpoints;
  • any misuse of the Company's platform that results in the generation of fraudulent or invalid Enquiries, whether by the User directly or by any third party acting with the User's knowledge, authority, or on the User's behalf; or
  • any breach by the User of clause 6 of these Terms.
7.3

The indemnities given in this clause 7 shall survive the termination or expiry of the User's access to or use of the Website and are in addition to, and not in substitution for, any other right or remedy available to the Company under applicable law.

8. Intellectual Property

8.1

All content published on this Website — including without limitation text, images, logos, trade marks, graphics, page layouts, source code, data compilations, and branding — is the intellectual property of the Company or its licensors and is protected by copyright, trade mark, and other applicable intellectual property laws of England and Wales and international conventions.

8.2

No part of this Website may be reproduced, distributed, modified, adapted, reverse-engineered, or used to create derivative works without the Company's prior written consent, save as expressly permitted by applicable law (including fair dealing for the purposes of non-commercial research or private study).

8.3

Nothing in these Terms confers upon the User any licence or right to use the Company's trade marks, trading names, or branding, whether registered or unregistered.

9. Limitation of Liability

9.1

To the fullest extent permitted by applicable law, the Company hereby excludes all liability — whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise — for:

  • any loss or damage arising from the User's use of, or inability to use, this Website or the Enquiry form;
  • any reliance placed by the User on information, content, or material published on this Website;
  • any loss or damage arising from any product, installation, service, or conduct provided or omitted by any Installer or Distribution Partner introduced through this Website;
  • any interruption, error, delay, omission, virus, or security incident affecting the Website or its underlying infrastructure;
  • the accuracy or completeness of any quotation, recommendation, Installer profile, or accreditation information; or
  • any indirect, consequential, special, or punitive loss, including loss of profit, loss of revenue, loss of anticipated savings, loss of business, loss of data, or loss of goodwill.
9.2

Nothing in these Terms shall limit or exclude the Company's liability for death or personal injury caused by its own negligence, for fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or restricted.

11. Data Protection and Privacy

11.1

The collection, use, and disclosure of personal data submitted through this Website is governed by our Privacy Policy and Cookie Policy, each of which is incorporated into these Terms by reference. By using this Website, the User confirms that they have read and understood both policies.

12. Governing Law and Jurisdiction

12.1

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

12.2

The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.
